INDUSTRIAL RELATIONS LAW
The course aims to provide students with in-depth knowledge of the legal aspects of the industrial relations system within the framework of European and international law. In particular, the aim of the course is to equip students with structured skills to deal with personnel management and union relations issues in the company.
Introduction to trade union law. Trade union freedom in the Constitution, the Workers' Statute and the overall legal system. The trade union: historical phenomenon and legal regulation.
II) Trade union representation and representation of workers in the workplace. Trade union activity in the workplace. Trade union rights and the repression of anti-union conduct.
III) The collective agreement. Art. 39 of the Constitution and its failure to implement. Binding and subjective effectiveness of the collective agreement of common law. The functions of the collective agreement.
The historical evolution of collective bargaining in Italy. The Protocol of 23 July 1993. The Framework Agreement of 22 January 2009. The implementing agreements of the QA, the FIAT dispute and the alternativity between the contractual levels. The Interconfederal Agreement between Confindustria, CGIL, CISL, UIL of 28 June 2011 and subsequent developments. The relationships between collective agreements. Collective bargaining and law. Collective bargaining in the public service. Trade unions and political system. Concertation.
The self-protection of collective interests and the right to strike. The freedom of strike. The ownership of the right to strike. Limits to the right to strike. Other forms of trade union struggle and lock-out.
The strike and essential public services. The law of June 12, 1990 n. 146, as amended by the law of April 11, 2000 n. 83. The rules for the exercise of the right to strike in essential public services. Agreements on essential services and other strike measures. The Commission to ensure the implementation of the strike law in essential public services and its powers. The sanctioning measures in case of violation of the rules. The precettazione: substantive and procedural aspects.

To support the examination by 6 CFU it is necessary to fully study the last edition of the textbook (currently the one of 2015, except later editions).
To support the examination of industrial relations law by 4 CFU it is necessary to study the whole textbook (June, Trade union law, cacucci, Bari, last edition), excluding chapters XI, XII, XIII, XIV.
Method of verification of learning: oral test

Frontal lessons, seminars.
Student preparation will be tested by oral exams. The assessment of the level of student preparation will be carried out by examining the knowledge and understanding of the subject during the oral interview, the candidate’s ability to draw consistent conclusions and the ability to respond to examination questions.
