Objectives

Educational goals:
The course aims to provide students with the tools of knowing and solving the legal problems posed by the collection, interconnection and use of large amounts of information, with regard to the privacy and security of data (personal and commercial), the legal nature and ownership of data, the contractual and liability profiles on the Internet.

Expected learning outcomes:
- Mastery of the method and the language of private law;
- Knowledge and understanding of the special legislation of the sector in the Italian-European system of sources, of national and European jurisprudence, of the proceedings of the Authorities, of the self-regulatory codes and, more generally, of the techniques of soft law that contribute to the regulation of the Internet network;
- Ability to correctly frame specific concrete problems from a legal point of view;
- Ability to argue the legal solution of practical issues of normal complexity.

Contents

The course will mainly focus on privacy (with particular regard to big data), the problems posed by the recent adoption of the 2016/679 / EU regulation, as well as manifested by the inadequacy of the existing regulatory tools to the growing complexity of the systems and rapidity of information flows. We will also proceed to the study of the conclusion of the contract by electronic means, the examination of IT contracts concerning hardware and software, out-sourcing contracts, contracts for access to the Internet,
civil damages in the Internet and the study of the related
civil liability.

1. Regulation of the Internet network - Examination of authoritative and non-authoritative sources. In particular. The Directive 2000/31 / CE, on Electronic Commerce
2. Civil Offenses on the Net - Examining the special responsibilities of the caching and hosting provider. Absence of a general obligation of surveillance and active research of offenses on the network, pursuant to art. 17 Legislative Decree n. 70 of 2003
3. Characters and nature of electronic civil liability.
4. Examination of jurisprudence (European and internal) on the subject of electronic civil liability
5. Information obligations in electronic commerce (Consumer Code and Legislative Decree No. 70 of 2003)

In addition, it’s advisable to study the doctrinal and jurisprudential material object of examination and deepening during the lessons (available, for those not attending classes, on the website of the Department of Juridical and Social Sciences, on the personal page of the teacher).

The constant consultation of the relevant internal and European legislation and the careful examination of the main jurisprudential judgments of the State and European Courts and of the sector application practices are indispensable for the knowledge of the subject.

Methods of Provision

Conventional

Teaching Methods

Teaching is structured in 48 hours of frontal teaching, consisting of theoretical lessons and practical exercises. It is also planned the organization of optional seminars in English.
Course attendance is optional and recommended.

Evaluation methods

Verification of learning:

Final oral exam aimed to verifying the knowledge of the treated institutions; an adequate capacity for exposure and the necessary mastery of the method and the language of Private law; the ability to correctly frame specific concrete problems from a legal point of view and to argue the legal solution of practical issues of normal complexity.

They can be expected partial tests (oral or written), to be carried out in the classroom, even in a collective way, reserved for attending students, whose purpose is to verify the understanding of the topics covered in class and the practical application of the arguments studied at a theoretical level.
